These Terms & Conditions (“Terms”) govern your access to and use of DeployNation.com (the “Website”), operated by DeployNation (“DeployNation,” “we,” “us,” or “our”).
By accessing or using this Website, submitting an inquiry or request for quote, or otherwise using Website features, you agree to these Terms. If you do not agree with these Terms, please do not use the Website.
These Terms primarily govern use of the Website. Specific services provided by DeployNation may also be governed by a quote, proposal, statement of work (“SOW”), master services agreement (“MSA”), work order, purchase order accepted by DeployNation, or other written agreement.
If a separate written agreement between DeployNation and a customer conflicts with these Terms regarding services performed under that agreement, the terms of the applicable written agreement will control to the extent of the conflict.
1. About DeployNation
DeployNation provides business-to-business IT infrastructure deployment and field services.
Services may include, depending on project scope:
- Rack and stack services
- Remote hands and smart hands
- IT field services
- Computer deployment
- Computer refresh projects
- IT relocation
- IT decommissioning
- Structured cabling
- Multi-site IT rollouts
- Network operations center services
- Hardware installation and replacement
- Physical infrastructure support
- Other related IT deployment and field services
The availability, scope, price, schedule, and requirements of any service depend on the specific project and are not established merely by information appearing on this Website.
2. Website Information Is Not a Service Agreement
Information on this Website is provided for general informational and business-development purposes.
Descriptions of services, capabilities, pricing, response times, coverage areas, project examples, or other information on the Website do not by themselves constitute a binding offer, service-level agreement, warranty, or guarantee.
A binding project commitment exists only when DeployNation and the customer have completed the applicable approval process, which may include acceptance of a quote, proposal, SOW, MSA, work order, or other written agreement.
3. Requests for Quotes
Submitting a Request a Quote form does not create a contract or obligate DeployNation to perform services.
Quotes and estimates may be based on information provided by the prospective customer. The customer is responsible for providing reasonably accurate information concerning the requested work, including relevant details such as:
- Locations
- Equipment
- Quantities
- Project requirements
- Required technician skills
- Access requirements
- Scheduling requirements
- Cabling requirements
- Site conditions
- Documentation requirements
- Required tools or equipment
- Customer-provided materials
- Other information material to the project
DeployNation may revise a quote or estimate if the project scope, site conditions, quantities, schedule, customer requirements, or other material circumstances differ from the information originally provided.
Unless otherwise stated in writing, Website pricing and pricing examples are planning estimates and do not constitute guaranteed project pricing.
4. Statements of Work and Project Scope
Services should be performed according to an agreed project scope.
An SOW, quote, work order, or similar project document may identify matters such as:
- Services to be performed
- Project locations
- Equipment involved
- Project schedule
- Technician requirements
- Deliverables
- Customer responsibilities
- Documentation requirements
- Pricing
- Travel expenses
- Materials
- Testing requirements
- Acceptance criteria
- Change procedures
- Other project-specific terms
Work outside the agreed scope may require a change order, revised quote, additional authorization, or additional charges.
DeployNation is not required to perform work materially outside an agreed scope without appropriate authorization.
5. Customer Responsibilities
Customers are responsible for providing the information, authorization, access, equipment, documentation, and cooperation reasonably necessary to perform an agreed project.
Depending on the project, customer responsibilities may include:
- Providing accurate site and project information
- Providing authorized access to facilities
- Coordinating building or data-center access
- Providing required badges, escorts, keys, or access credentials
- Obtaining necessary internal approvals
- Identifying authorized contacts
- Providing accurate rack elevations, port maps, runbooks, diagrams, or instructions
- Providing equipment and materials the customer has agreed to supply
- Ensuring equipment is available at the project location when required
- Maintaining appropriate backups of systems and data
- Providing appropriate remote engineering support where required
- Obtaining necessary permits or approvals unless expressly included in DeployNation’s scope
- Identifying site-specific safety requirements
- Providing a reasonably safe working environment
DeployNation is not responsible for delays or additional costs caused by inaccurate information, unavailable equipment, denied access, unavailable customer personnel, missing approvals, unsafe conditions, or other circumstances outside DeployNation’s reasonable control.
6. Customer Authorization
By requesting that DeployNation perform work on equipment, infrastructure, systems, networks, facilities, or property, the customer represents that it has authority to authorize the requested work.
The customer is responsible for obtaining any permissions required from property owners, landlords, data centers, colocation providers, equipment owners, employers, customers, or other relevant parties.
DeployNation may decline or suspend work when authorization is unclear or reasonably disputed.
7. Technical Instructions and Change Control
Many DeployNation services involve executing a customer’s existing technical plan, runbook, configuration, diagram, port map, or engineering instructions.
Unless expressly included within the agreed scope, DeployNation field technicians are not responsible for independently redesigning a customer’s network, architecture, security policy, application environment, or engineering plan.
If a technician encounters circumstances that materially differ from the provided instructions or scope, DeployNation may pause the affected work and request clarification or authorization.
Material changes to the scope may result in additional charges or schedule changes.
8. Credentials and System Access
Customers should provide only the access necessary to perform an authorized project.
Customers remain responsible for managing their systems, accounts, passwords, permissions, and security policies unless a written agreement expressly assigns a particular responsibility to DeployNation.
Sensitive credentials should not be submitted through ordinary Website contact or quote forms.
Where system credentials or privileged access are required for a project, the parties should use an appropriate approved method for providing and managing such access.
Customers should revoke temporary access when it is no longer required.
9. Backups and Data Protection
Unless expressly included in a written agreement, customers are responsible for maintaining appropriate backups of systems, configurations, applications, and data before DeployNation performs work that could affect those systems.
Physical IT work can involve hardware replacement, cabling changes, equipment moves, power changes, component replacement, decommissioning, or other activities that may affect system availability.
Customers should maintain backup and recovery procedures appropriate for their environment.
DeployNation does not guarantee that customer data can be recovered following equipment failure, pre-existing corruption, configuration errors, customer instructions, third-party failures, or circumstances outside the agreed scope.
10. Third-Party Hardware, Software, and Services
DeployNation frequently works with hardware, software, networks, facilities, carriers, cloud platforms, data centers, manufacturers, vendors, and other products or services supplied by third parties.
Unless expressly stated otherwise in writing, DeployNation does not manufacture and does not independently warrant third-party products.
Third-party products and services may be subject to separate licenses, warranties, service agreements, support policies, and terms established by their respective providers.
DeployNation is not responsible for failures or limitations attributable to third-party products or services except to the extent responsibility is expressly assumed in a written agreement.
11. Technicians, Contractors, and Service Partners
DeployNation may use qualified employees, independent technicians, subcontractors, vendors, or service partners to fulfill projects when appropriate.
This model enables DeployNation to support customers across multiple geographic locations and project types.
DeployNation may provide assigned personnel with project information reasonably necessary to perform their authorized work.
Confidential and personal information will be handled in accordance with applicable agreements and our Privacy Policy.
12. Structured Cabling and Regulated Work
Certain cabling, electrical, low-voltage, construction, permitting, or related activities may be subject to licensing, permitting, inspection, or other regulatory requirements that vary by jurisdiction and project.
Where required, regulated work may be performed or coordinated through appropriately qualified or licensed providers.
DeployNation may decline, subcontract, refer, or modify the scope of work where licensing, permitting, safety, or regulatory requirements make doing so appropriate.
Nothing on this Website represents that DeployNation itself holds every license or certification that may be required for every type of work in every jurisdiction.
13. Scheduling and Nationwide Coverage
DeployNation provides and coordinates IT deployment and field services across the United States.
References to “nationwide” service or coverage mean that DeployNation may provide or coordinate services in multiple markets throughout the United States. They do not guarantee technician availability in every location at every time.
Technician availability may depend on:
- Geographic location
- Required skill level
- Scheduling
- Project size
- Site-access requirements
- Required certifications
- Weather
- Travel requirements
- Equipment availability
- Customer requirements
- Other operational considerations
A requested appointment, dispatch, or project date is not guaranteed until confirmed by DeployNation.
14. Project Delays and Events Outside Our Control
DeployNation will make reasonable efforts to perform confirmed services according to the applicable project schedule.
However, project schedules may be affected by circumstances outside our reasonable control, including:
- Severe weather
- Natural disasters
- Transportation disruptions
- Facility closures
- Site-access problems
- Customer delays
- Equipment shipping delays
- Hardware shortages
- Carrier outages
- Utility outages
- Labor disruptions
- Government actions
- Emergencies
- Third-party failures
- Unsafe working conditions
- Other events beyond reasonable control
Where practical, DeployNation will communicate material scheduling issues and work with the customer regarding reasonable next steps.
15. Cancellations and Rescheduling
Project-specific cancellation and rescheduling terms may be established in the applicable quote, SOW, work order, or other written agreement.
Late cancellations, denied site access, missed appointments, or rescheduling after technicians have been assigned or dispatched may result in charges for committed labor, travel, expenses, minimum service periods, or other nonrecoverable costs where provided by the applicable agreement.
Any applicable cancellation charges should be identified in the relevant project documentation.
16. Pricing, Expenses, and Payment
Pricing may be based on hourly labor, minimum service periods, per-device pricing, per-site pricing, project pricing, recurring service fees, materials, travel, expenses, or another agreed pricing structure.
Final pricing depends on the applicable project scope.
Customers are responsible for authorized charges identified in an applicable quote, invoice, SOW, work order, MSA, or other written agreement.
Payment terms, invoicing schedules, deposits, retainers, taxes, reimbursable expenses, late charges, and other financial terms may be established separately for each customer or project.
If project-specific payment terms conflict with this Website, the project-specific written agreement controls.
17. Taxes
Customers are responsible for applicable sales, use, excise, or similar taxes associated with purchased services or materials except taxes imposed on DeployNation’s net income, unless otherwise required by law or agreed in writing.
Customers claiming tax-exempt status may be required to provide appropriate documentation.
18. Confidentiality
DeployNation recognizes that IT projects may involve confidential business and technical information.
DeployNation will use reasonable measures to protect confidential information provided in connection with a project and will use such information for legitimate business and project purposes.
Project-specific confidentiality obligations may also be established through an MSA, nondisclosure agreement, SOW, or other written agreement.
Customers should not submit highly sensitive credentials, encryption keys, regulated data, or other information unnecessary for a project through general Website forms.
19. Website Acceptable Use
You may use this Website only for lawful purposes.
You may not knowingly:
- Attempt unauthorized access to the Website or related systems

DeployNation may restrict access to the Website when reasonably necessary to protect the Website, its users, or our systems.
20. Intellectual Property
Unless otherwise indicated, the Website and its original content, branding, design elements, text, graphics, logos, service descriptions, and other materials are owned by or licensed to DeployNation and are protected by applicable intellectual property laws.
You may view and use Website content for legitimate informational and business purposes.
You may not reproduce, distribute, republish, sell, modify, or commercially exploit substantial portions of the Website without authorization, except as permitted by applicable law.
“DeployNation” and associated branding may not be used in a manner that falsely suggests affiliation, endorsement, sponsorship, or authorization.
21. Customer Materials
Customers retain their rights in documents, diagrams, photographs, data, instructions, trademarks, and other materials they provide to DeployNation.
By providing such materials for a project, the customer grants DeployNation permission to use, reproduce, transmit, and provide those materials to authorized personnel to the extent reasonably necessary to evaluate, coordinate, perform, document, or support the requested services.
The customer represents that it has sufficient authority to provide materials necessary for the project.
22. Feedback and Reviews
Customers and Website users may provide feedback regarding DeployNation and its services.
Nothing in these Terms is intended to prohibit or penalize anyone for providing an honest review or assessment protected by applicable law.
The FTC specifically states that standardized contract terms cannot prohibit or penalize honest consumer reviews or improperly require reviewers to surrender intellectual-property rights in their reviews.
23. Website Availability
We seek to maintain an accurate and functional Website, but we do not guarantee that the Website will always be uninterrupted, error-free, secure, or available.
We may modify, suspend, restrict, or discontinue Website features at any time.
Website interruptions do not modify the terms of a separately confirmed project unless the applicable written agreement provides otherwise.
24. Website Disclaimer
To the fullest extent permitted by applicable law, the Website and general informational content are provided on an “as is” and “as available” basis.
DeployNation makes no representation that general Website information is suitable for every customer’s technical environment or project.
Nothing published on the Website should replace project-specific technical evaluation, engineering judgment, manufacturer instructions, applicable codes, or an agreed statement of work.
25. Service Warranties
Any warranty, service commitment, acceptance criterion, remediation obligation, or service level applicable to a particular project will be governed by the applicable written agreement.
Except for warranties expressly provided in an applicable written agreement, and to the fullest extent permitted by law, DeployNation disclaims warranties regarding services or Website content that may otherwise be implied by law, including implied warranties of merchantability, fitness for a particular purpose, and non-infringement.
Some jurisdictions do not permit certain warranty exclusions. In those circumstances, the exclusions apply only to the extent permitted by applicable law.
26. Limitation of Liability
To the fullest extent permitted by applicable law, DeployNation will not be liable for indirect, incidental, special, exemplary, punitive, or consequential damages arising from or related to use of the Website or services, including loss of profits, revenue, business opportunities, goodwill, or data, except where such limitations are prohibited by law or modified by a written agreement.
For services performed for a customer, applicable limitations of liability may be further defined in the governing MSA, SOW, work order, or other written agreement.
Nothing in these Terms excludes or limits liability to the extent such liability cannot lawfully be excluded or limited.
27. Indemnification
To the extent permitted by applicable law, you agree to indemnify and hold DeployNation harmless from third-party claims, damages, liabilities, costs, and reasonable expenses arising from your unlawful use of the Website, your material violation of these Terms, or materials or instructions you provide without sufficient authorization.
Project-specific indemnification obligations, if any, will be governed by the applicable written agreement.
28. No Professional Engineering or Legal Advice
General information published by DeployNation concerning IT infrastructure, cabling, data centers, deployment practices, equipment, or related subjects is provided for informational purposes.
Unless expressly included in a written scope of work, Website content does not constitute professional engineering, architectural, legal, regulatory, cybersecurity, or compliance advice.
Customers remain responsible for obtaining specialized professional advice when their project requires it.
29. Privacy
Use of the Website is also subject to our Privacy Policy.
The Privacy Policy describes how DeployNation may collect, use, disclose, retain, and protect information.
If we use analytics technologies such as Google Analytics, our Privacy Policy and Cookie Policy will provide additional information concerning those technologies and available privacy choices.
30. Electronic Communications
When you submit a Website form, send us an email, or otherwise communicate electronically with DeployNation, you consent to receiving communications from us electronically concerning that inquiry or business relationship, subject to applicable law.
Electronic records and signatures may have legal effect in transactions under federal law; the federal E-SIGN framework generally provides that a contract or signature cannot be denied legal effect solely because it is electronic.
Marketing communications, if used, will be handled separately from necessary project and transactional communications. Federal CAN-SPAM requirements also apply to qualifying commercial email, including business-to-business commercial email.
31. Governing Law
These Terms and your use of the Website will be governed by the laws of the State of Colorado, without regard to conflict-of-law principles, except to the extent another law must apply.
Project-specific agreements may establish separate governing-law, venue, dispute-resolution, or arbitration provisions.
32. Dispute Resolution and Venue
Before initiating formal legal proceedings concerning the Website, the parties are encouraged to make reasonable efforts to resolve the dispute through direct communication.
Unless a separate written agreement provides otherwise, and subject to applicable law, disputes concerning these Website Terms will be brought in a court of competent jurisdiction in the State of Colorado.
Nothing in this section prevents either party from seeking emergency or injunctive relief where legally appropriate.
33. Severability
If any provision of these Terms is determined to be invalid, illegal, or unenforceable, that provision will be interpreted or limited to the extent reasonably necessary to make it enforceable where possible.
The remaining provisions will continue in effect.
34. Waiver
A failure by DeployNation to enforce a provision of these Terms on one occasion does not constitute a waiver of that provision or the right to enforce it in the future.
35. Assignment
You may not assign rights or obligations arising under these Terms without DeployNation’s prior written consent where consent is legally permitted to be required.
DeployNation may assign these Terms in connection with a merger, acquisition, corporate reorganization, sale of assets, or similar business transaction, subject to applicable law.
36. Changes to These Terms
DeployNation may update these Terms periodically to reflect changes in our Website, services, business practices, or legal requirements.
The revised Terms will be posted on this page with an updated Last Updated date.
Changes will apply prospectively unless otherwise permitted or required by law.
Material changes affecting an existing customer engagement will remain subject to any applicable MSA, SOW, or other written agreement.
37. Entire Agreement for Website Use
These Terms, together with the Privacy Policy and other policies expressly incorporated into them, constitute the agreement governing general use of the Website.
They do not replace an applicable MSA, SOW, work order, quote, NDA, purchase agreement, or other written agreement governing services between DeployNation and a customer.
